Terms of Service

1. Agreement
These Terms of Service (“Terms”) are an agreement between you and Overday Labs (“we,” “us”), the operator of Dayoutly at dayoutly.com (the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. What the Service is
Dayoutly aggregates information about local events and activities from publicly available sources — venue websites, city calendars, ticketing platforms, and similar — and presents it in one place. We are an information service only: we do not organize, host, endorse, or sell tickets to the events listed, and we are not affiliated with event organizers unless expressly stated.
3. Event information is not guaranteed
Event details (dates, times, prices, locations, age requirements, availability) come from third-party sources and can change or contain errors. We work to keep listings accurate, but always confirm details with the event organizer or venue before making plans or purchases. We are not responsible for cancelled, changed, sold-out, or inaccurately listed events, or for anything that occurs at an event.
4. Eligibility and accounts
You must be at least 13 years old to create an account. You are responsible for your account credentials and for activity under your account. We may suspend or terminate accounts that violate these Terms. You may delete your account at any time by contacting us at hello@dayoutly.com.
Some listings are marked for adult audiences (18+ or 21+). Age requirements for events are set and enforced by the organizers, not by us.
5. Acceptable use
You agree not to:
- use the Service for any unlawful purpose;
- scrape, harvest, or bulk-download content from the Service by automated means;
- interfere with or disrupt the Service or its infrastructure;
- attempt to access accounts or data that are not yours;
- misrepresent your affiliation with any person or organization.
6. Third-party links and affiliate disclosure
The Service links to third-party websites (venues, organizers, ticket sellers). We are not responsible for their content, policies, or transactions you make there. Some outbound links may be affiliate links, meaning we may earn a commission if you make a purchase — at no additional cost to you.
7. Intellectual property
The Service’s design, software, and original content are owned by Overday Labs. Event names, descriptions, and images belong to their respective owners and are displayed for informational purposes with links to the original source. If you own content shown on the Service and want it corrected or removed, contact us at hello@dayoutly.com and we will respond promptly.
8. Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
9. Limitation of liability
To the maximum extent permitted by law, Overday Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service — including reliance on event information or attendance at any listed event. Our total liability for any claim relating to the Service will not exceed one hundred US dollars ($100).
10. Changes to the Service or these Terms
We may modify or discontinue the Service at any time. We may update these Terms; if changes are material, we will update the effective date above and, where practical, provide notice in the app. Continued use after changes take effect constitutes acceptance.
11. Governing law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules.
12. Privacy
Our Privacy Policy describes what data we collect and how we use it.
